Terms of Use

You must be at least 13 years old to use the Services, and at least 18 (or the age of majority where you live) to create an account or submit content. By using the Services, you represent that you meet these requirements and that the information you provide is accurate.

Some features require an account, which you create by signing in with a supported provider. You are responsible for activity that occurs under your account and for keeping your login secure. Notify us promptly at kongmoongchi@gmail.com if you suspect unauthorized use. You may delete your account at any time from within the Services.

The Services provide information and analysis about cosmetic and skincare ingredients, drawing on public databases and automated tools, and let you request products, save routines, and post reviews. The Services are an informational and educational tool only.

Parts of the Services use artificial intelligence and automated systems to read labels, analyze ingredients, and generate results. AI output can be wrong, incomplete, or misleading and is not reviewed by a professional. You are responsible for independently verifying any information before relying on it. We make no guarantee that AI-generated results are accurate, current, or suitable for any purpose.

"User Content" means anything you submit, such as reviews, ratings, product requests, ingredient lists, photos, and notes. You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and publish it in connection with operating, promoting, and improving the Services. This license continues for content you have made public (such as posted reviews) even after you delete your account, to the extent others have relied on or interacted with it.

Your responsibilities

You represent that your User Content is accurate to the best of your knowledge and that you will not post content that:

• Is false, misleading, defamatory, harassing, or unlawful;
• Infringes anyone's intellectual property, privacy, or other rights;
• Contains another person's private or sensitive information without permission;
• Makes unsupported medical or safety claims, or promotes unsafe use of a product;
• Contains malware, spam, or automated or fake reviews.

We may remove, moderate, or refuse any User Content and may suspend accounts that violate these Terms, but we are not obligated to monitor or screen content and are not responsible for User Content posted by others. Reviews reflect the opinions of the individuals who posted them, not us.

You agree not to:

• Use the Services in violation of any law or these Terms;
• Scrape, crawl, harvest, or bulk-download content except as expressly permitted;
• Reverse engineer, interfere with, overload, or attempt to gain unauthorized access to the Services;
• Misrepresent your identity or affiliation, or use the Services to mislead others;
• Resell or commercially exploit the Services or their content without our written permission.

The Services, including their design, text, graphics, logos, and software (excluding User Content and third-party content), are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Services for their intended purpose. All rights not expressly granted are reserved. "The Alkimists" and our logo are our trademarks and may not be used without our permission.

The Services contain affiliate links, including through the Amazon Associates program, and we may earn a commission when you purchase through them at no additional cost to you. Affiliate relationships do not influence our ingredient analysis. Product listings, prices, availability, and third-party content may be inaccurate or out of date, and purchases you make from third parties are governed by their terms, not ours. We are not responsible for third-party websites, products, or services.

If you believe content on the Services infringes your copyright, send a notice to kongmoongchi@gmail.com including: your contact information; identification of the copyrighted work; identification of the allegedly infringing material and its location; a statement of good-faith belief that the use is unauthorized; a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and your physical or electronic signature. We may remove allegedly infringing material and terminate repeat infringers.

You agree to indemnify and hold harmless The Alkimists and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Services, or your violation of these Terms or of any law or third-party right.

You may stop using the Services and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Services or other users. Sections that by their nature should survive termination (including Sections 5, 7, and 10–15) will survive.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

Informal resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at kongmoongchi@gmail.com and allowing 60 days to resolve it.

Binding arbitration

Except for small-claims matters and requests for injunctive relief, any dispute arising out of or relating to the Services or these Terms will be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, seated in or near Los Angeles County, California, or conducted remotely. Judgment on the award may be entered in any court with jurisdiction.

Class-action waiver

You and we agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. If this waiver is found unenforceable, the arbitration provision will be void as to that dispute.

Right to opt out of arbitration

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing kongmoongchi@gmail.com with your name and a statement that you opt out. Opting out does not affect the other provisions of these Terms.

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, provide more prominent notice. Your continued use of the Services after changes take effect means you accept the revised Terms.

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
